Empowered Ed Pty Ltd – Digital Resource Refund Policy Terms

In this policy, “us”, “we”, or “our” means Jodie Clarke, The Empowered Educator, Empowered Ed Pty Ltd – operator of this website.

We may change part or all of the Digital Refunds Policy at any time. The most current Policy will always be posted on this website.

At the Empowered Educator Blog Shop, the resources you purchase are delivered electronically. That means that unlike a t-shirt or a print book, you can't (really) return a PDF, Word document, or another file once you've already downloaded it. For that reason, all sales of digital products on The Empowered Educator are considered final and nonrefundable.

I do understand though that things don't always go as planned, so The Empowered Educator offers refunds in a few limited circumstances. If your digital resource purchase falls into one of the exceptions listed below, you may be eligible for a refund.

Refunds will be issued to the extent required by the Trade Practices Act 1974 (Cwth) and Sale of Goods Act 1958 (Vic). No part of these terms of use is to be taken as an express or implied repudiation of our obligations under these pieces of legislation.

Refund requests must be submitted within one year of your purchase and are granted on a case-by-case basis using the exception criteria listed below.

  • Resource File Error - A resource file is damaged or is missing content. Example: A mini-guide or extract of the resource has been uploaded instead of the resource itself.
  • Misrepresentation - The images and/or description on the digital resource information and shop page misrepresents what is actually contained in the resource. (Requests are subject to Empowered Educator review.) Example: A product description states there are 10 templates or e-books included in the bundle but there are in fact only 5 included when you download the resource.
  • Technical Limitations — You are unable to access a resource because the technical requirements aren't included in the resource description. Example: A resource is in ‘PDF document format’ or ‘only works on android devices’ but this is not listed anywhere on the product information page.
  • Duplicate Purchase — You purchase the same resource twice. Example: You purchase a resource contained in a specific bundle and then later purchase that bundle within one year of the original purchase. This does not apply to single resources that may be included in similar but separate bundles along with other digital resources. For refund to be applicable the duplicate purchase must be the same bundle or individual product purchase. It is your responsibility as the purchaser to ensure you thoroughly read the resource product information page and note the resources listed as included.
  • File Download Status — You purchased a resource but never downloaded the file from your "Download Receipt" email (This action can be verified by The Empowered Educator shop and email records). This does not pertain to resources you have already downloaded but misplaced or deleted in your own records, files or devices. It is your responsibility to back up all downloaded resource purchases on your own system.
    Example: 
    You purchased a template resource at the beginning of the year and didn’t download your file to your own computer or device but some months later you remember you ordered the template resource but the link has now expired so you can no longer access the resource. This does not apply to purchases The Empowered Ed team verifies as previously being downloaded from your shop account and the receipt email initially provided. It is your responsibility to remember where you have downloaded and saved your resources.

Empowered Ed Pty Ltd – Subscription Refund Policy Terms

Section 1. SUBSCRIPTION PAYMENTS/RECURRING BILLING

Access to the ACADEMY FOR EMPOWERED EDUCATORS is via monthly (30 days) automated billing or annual (365 days) automated billing. If you wish to cancel your subscription/recurring billing, login to the Member portal and complete the cancellation request form. Your account will remain active until the current term has expired and you will receive an email confirming your account cancellation. No further payments will be taken from your account.

Terms of purchase (a recurring subscription payment monthly or annually) are clearly described on both the checkout page and again in the associated new member welcome emails so purchasers can make an informed choice regarding initiating a subscription.

A subscription payment agreement can be cancelled at anytime by you as a current member using the request form on your Member Homepage or HERE.

Declined payments will automatically be retried for a period of three (3) days. If payment is declined again on the fourth attempt your account will be suspended until you log in to the Member Account portal and re-start billing.

Members are responsible for full payment of recurring subscription fees for their monthly or annual membership as clearly explained during the initial checkout and purchase process. Members understand that they are purchasing a subscription membership that can be cancelled at anytime and these monthly fees are non-refundable after the date due.

Members recognise that they are not agreeing to a one off payment (unless they choose to cancel after the first month). 'I was unaware it was a recurring payment' will not be accepted as eligibility for a refund as payment terms are clearly outlined before any purchase is made.

The Empowered Educator recognises and understands that things don't always go as planned, so refunds are sometimes offered in a few limited circumstances. If your membership refund request falls into one of the exceptions listed below, you may be eligible for a refund.

Refund requests must be submitted within 5 days after your latest recurring purchase and are granted on a case-by-case basis using the exception criteria listed below.

  • Duplicate Purchase — You purchase the same membership twice or someone else purchases a membership for you. Example: Your centre director agrees to pay your membership annually for professional development purposes and you no longer need to keep you monthly subscription. 
  • Illness or Family Emergency   — You currently pay a monthly subscription but due to emergency circumstances you were unable to access member hub. Eligibility for a refund will depend on individual circumstances and the final decision is made by Jodie Clarke.
  • Annual Reminder Missed  — You currently pay an annual subscription but missed the 3 reminder emails sent out before your next annual payment is due again and did not want to purchase another 12 months of membership. Eligibility for a refund in these circumstances will be made on a case by case basis by Jodie Clarke and is not automatically approved.

'I was unaware it was a recurring payment' is NOT accepted as eligibility for a refund under any circumstances as payment terms are clearly outlined before any purchase is made on the information page, checkout page and in follow up emails to members. The Empowered Educator is very transparent about The Academy being a subscription service customers purchase as a monthly or annual instalment.

Section 2. ACADEMY SPECIAL PRICE TRIAL PERIODS

The Empowered Educator may, at sometimes during promotional periods, offer the first month or 2 weeks Academy membership at a reduced rate. This offer is non-transferable and may only be redeemed once. Any further attempts to join at the discounted trial price may be declined. The promotional price is for 1 month (30 days) or (where specified) $2 for a 14 day period and after the initial 30 or 14 day period (As applicable) if membership is not canceled the full monthly membership of $39AUD (inc GST for AU residents) will be charged monthly (every 30 days) until membership is canceled.

It is the sole responsibility of the member to login to their member homepage found HERE to cancel membership by completing the Academy Query Form and choosing the box that requests cancellation of membership. No refunds shall be offered outside of the conditions listed above in section 1 for members who do not cancel with the trial period.

Cancelling within the trial period will allow members to retain the balance of their membership so content can be accessed until the end of the 30 day/14 day period even if membership has been canceled.

Any special price offers are for new members only and can not be redeemed by existing Academy members, both current, canceled and expired unless given permission from The Empowered Educator Online to specifically do so.
